Terms of Service & General Conditions of Sale

1. General Information

These Terms of Service ("Terms") and General Conditions of Sale ("GCS") govern your use of the 8BitForge platform ("Service") and any purchases made through it.

The Service is operated by:

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the Service

8BitForge is a web-based music production studio specializing in chiptune and 8-bit music creation. The Service includes:

• A step sequencer, piano roll, and arrangement editor
• A synthesis engine with multiple oscillators and effects
• Cloud storage for projects, presets, and instrument kits
• Export capabilities in various audio formats
• Community features for sharing presets and kits

3. Account Registration

• You must provide a valid email address and choose a username.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years old to create an account.
• One account per person. Multiple accounts may be suspended.

4. Free Plan

The Free plan provides full access to all creative tools at no cost. Limitations include:

• MP3 export only (full track)
• Up to 20 cloud projects
• Official presets and kits only
• Non-commercial license (personal use only)

The Free plan is not a trial — it is a permanent offering that may be used indefinitely.

5. Paid Plans & Pricing

5.1 Plans

All prices are in US Dollars (USD) and include applicable taxes where required. Prices may be updated; existing subscribers will be notified 30 days in advance of any price change.

5.2 What Paid Plans Include

• All features of the Free plan
• Commercial license for music created with the Service
• Export in WAV, MP3, FLAC, OGG, AIFF formats
• MIDI export (Type 0 & 1)
• Stems and per-pattern export
• Sample rates up to 96kHz / 32-bit
• Custom presets and kits (save & share)
• Community presets and kits
• Cloud + local save
• Unlimited projects

5.3 Pro Perpetual License Specifics

The Pro Perpetual license includes priority support and free minor updates. Major version upgrades (e.g., v2.0, v3.0) may require an optional paid upgrade at a reduced price. Your current version will continue to work indefinitely.

6. Payment & Billing

• Payments are processed securely by Stripe, Inc.
• We accept major credit cards (Visa, Mastercard, American Express), and other methods supported by Stripe in your region.
• Recurring subscriptions (Pro Creator Monthly, Pro Creator Yearly) are automatically renewed unless canceled before the renewal date.
• You can cancel your subscription at any time from your account page. Cancellation takes effect at the end of the current billing period — no prorated refunds.

7. Right of Withdrawal (EU Consumers)

In accordance with EU Directive 2011/83/EU and French Consumer Code (Article L221-28), you acknowledge that:

• For subscriptions (Pro Creator Monthly/Yearly): You have a 14-day right of withdrawal from the date of purchase, provided you have not used the premium features during that period. If you have accessed premium features, you expressly waive your right of withdrawal.
• For one-time purchases (Pro Perpetual): The same 14-day withdrawal right applies. Once you have accessed the premium features, the right of withdrawal is waived.

8. Intellectual Property

8.1 Your Content

You retain full ownership of all music, projects, presets, and kits you create using 8BitForge. We claim no intellectual property rights over your creative output.

8.2 Commercial License

Paid plan holders receive a commercial license to use music created with the Service for any purpose, including:

• Selling or distributing music
• Using music in games, videos, streams, or other media
• Monetizing content that includes music made with 8BitForge

Free plan users may use their creations for personal, non-commercial purposes only.

8.3 Our Content

The 8BitForge platform, its code, design, official presets, kits, and documentation are the intellectual property of 8Binami. You may not copy, modify, distribute, or reverse-engineer any part of the platform.

9. Community Content

By sharing presets or kits publicly on the platform, you grant other users a non-exclusive license to use them within 8BitForge. You may remove shared content at any time, but copies already downloaded by other users remain usable.

10. Acceptable Use

You agree not to:

• Use the Service for illegal purposes
• Attempt to gain unauthorized access to other accounts or systems
• Upload malicious content or exploit vulnerabilities
• Share content that is offensive, defamatory, or infringes on others' rights
• Use bots or automated tools to create accounts or abuse the Service
• Resell or redistribute access to the Service

We reserve the right to suspend or terminate accounts that violate these Terms.

11. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any loss resulting from downtime.

12. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind.
• 8Binami is not liable for indirect, incidental, or consequential damages.
• Our total liability is limited to the amount you paid in the 12 months preceding the claim.

13. Account Termination

• You may delete your account at any time by contacting hello@8binami.com.
• Upon deletion, your data will be permanently removed within 30 days (except billing records retained as required by law).
• We may suspend or terminate accounts that violate these Terms, with prior notice when feasible.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email or a prominent notice on the platform at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.

15. Governing Law & Disputes

These Terms are governed by the laws of France. Any disputes shall be submitted to the competent courts of Perpignan, France, except where EU consumer protection regulations provide otherwise.

EU consumers may also use the European Online Dispute Resolution platform.
